1. Acceptance of Terms

By accessing and using SellFast.ae (the "Platform"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Platform. Your continued use of the Platform constitutes acceptance of any modifications to these terms.

The Platform, including all real estate activities and services, is operated by Jaqler Properties LLC, a company registered and operating in the United Arab Emirates.

2. Platform Role and Liability Disclaimer

IMPORTANT: SellFast.ae operates solely as a facilitator and intermediary marketplace platform connecting buyers and sellers.

• We DO NOT own, sell, or buy any items listed on the Platform
• We DO NOT hold, store, or transfer transaction funds between parties
• We DO NOT provide escrow or payment processing services
• We DO NOT guarantee the quality, condition, legality, or authenticity of any items
• We ARE NOT party to any transaction between users
• We DO NOT provide warranties of any kind regarding items, transactions, or payments
• All transactions and payments are directly between buyer and seller
• Users assume ALL risks associated with transactions and payments
• Our role is limited to verification, contract facilitation, and process coordination

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts under UAE law to use SellFast.ae. By using our services, you represent and warrant that you meet these requirements and have the legal authority to enter into these Terms.

4. Account Registration and Verification

To access certain features, you must create an account and complete our verification process:

• Provide accurate and complete information during registration
• Submit valid identification documents (Emirates ID or Passport)
• Complete video verification for identity confirmation
• Maintain the confidentiality of your account credentials
• Notify us immediately of any unauthorized access to your account
• You are solely responsible for all activities under your account

We reserve the right to refuse, suspend, or terminate accounts at our sole discretion without liability. Verification does not constitute endorsement or guarantee of user trustworthiness.

5. User Responsibilities and Obligations

As a user of SellFast.ae, you agree to:

• Provide accurate information in all listings and transactions
• Comply with all applicable laws and regulations in the UAE
• Not engage in fraudulent or deceptive practices
• Not misrepresent the condition or ownership of items
• Conduct your own due diligence before any transaction
• Verify all information independently
• Complete transactions in good faith once agreed upon
• Bear all risks associated with your transactions

6. Listing and Sale of Items

When creating a listing, sellers must:

• Have legal ownership and right to sell the listed item
• Provide accurate descriptions, photos, and documentation
• Set fair and reasonable asking prices
• Maintain the item's condition as described until sale completion
• Honor accepted bids and follow through with transactions
• Warrant that items are not stolen, counterfeit, or illegal

Sellers are solely responsible for all claims, disputes, or legal issues arising from their listings. SellFast.ae assumes no liability for seller representations or item conditions.

7. Bidding and Purchasing

Buyers agree to:

• Submit bids in good faith with intent to purchase
• Complete payment within 24 hours of bid acceptance
• Pay all applicable fees including commission (5% for cars/watches, 3% for real estate)
• Provide proof of payment as required
• Complete all necessary paperwork and transfers
• Conduct their own inspection and due diligence
• Accept items in "as-is" condition unless explicitly misrepresented

Buyers are solely responsible for verifying item condition, authenticity, and legality before purchase.

8. Commission and Fees

Our fee structure is transparent and straightforward:

• All platform fees are clearly disclosed before bid submission
• Government fees apply separately (DLD fees for real estate, RTA fees for cars) and are NOT paid to SellFast.ae
• All platform fees are non-refundable unless explicitly stated in our Refund Policy

We reserve the right to modify fee structures with 30 days notice. Users are responsible for reviewing current fees before each transaction.

9. Transaction Process and Facilitation Services

IMPORTANT: SellFast.ae is a facilitation platform ONLY. We do NOT hold, store, or transfer transaction funds.

Our transaction facilitation process includes:

• Bid submission and seller acceptance
• Digital contract creation and signing by both parties
• Connecting verified buyer and seller for direct coordination
• Guiding parties through payment and handover process
• Facilitating identity and item verification steps
• Coordinating item transfer and documentation

Transaction payments are made DIRECTLY between buyer and seller. SellFast.ae only receives the commission fee, which is paid separately by the buyer. We recommend bank transfers for all direct payments between parties.

CRITICAL DISCLAIMER: We do not provide escrow services. We do not hold funds. All payments between buyer and seller are their sole responsibility. Our role is limited to verification, coordination, and facilitation. We assume NO liability for payment disputes, delays, or failures between parties.

10. Cancellations and Refunds

Cancellation policies vary by transaction stage. Please refer to our Refund Policy for detailed information. All refund decisions are at our sole discretion and are not guaranteed.

11. Prohibited Activities

Users are strictly prohibited from:

• Listing stolen, counterfeit, or illegally obtained items
• Providing false information or documentation
• Attempting to circumvent platform fees or processes
• Engaging in money laundering, fraud, or other illegal activities
• Harassment or abusive behavior toward other users or staff
• Attempting to hack or compromise platform security
• Creating multiple accounts to manipulate the system
• Interfering with other users' transactions

Violation of prohibited activities may result in immediate account termination, legal action, and reporting to authorities, all at our sole discretion.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY UAE LAW:

• SellFast.ae is NOT liable for any direct, indirect, incidental, or consequential damages
• We are NOT responsible for accuracy of user-provided information
• We are NOT responsible for quality, condition, legality, or authenticity of listed items
• We are NOT responsible for disputes arising from transactions
• We are NOT responsible for loss or damage during transfer of items
• We are NOT responsible for failures in payment processing or bank transfers
• We are NOT responsible for actions or omissions of users
• Users assume ALL risks associated with using the Platform and completing transactions

Our maximum liability for any claim shall not exceed the commission fees paid to us for the specific transaction in question, and in no event shall exceed AED 1,000.

13. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties regarding availability, reliability, or security
• Warranties regarding accuracy or completeness of content

We do not warrant that the Platform will be uninterrupted, secure, or error-free.

14. Indemnification

You agree to indemnify, defend, and hold harmless SellFast.ae, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your listings, transactions, or interactions with other users
• Any false or misleading information you provide

15. Dispute Resolution and Arbitration

In case of disputes, users agree to first work with SellFast.ae's internal dispute resolution process. If internal resolution fails, disputes shall be resolved through binding arbitration in Dubai, UAE, in accordance with UAE arbitration laws. See our Dispute Resolution page for full details.

BY USING THIS PLATFORM, YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.

16. Intellectual Property

All content on SellFast.ae, including logos, designs, text, and graphics, is owned by SellFast.ae and protected by intellectual property laws. Users may not use our intellectual property without written permission. Users grant us a non-exclusive, royalty-free license to use content they post on the Platform.

17. Termination

We reserve the right to suspend or terminate accounts at any time, with or without notice, for any reason or no reason, including but not limited to violations of these Terms or prohibited activities. Users may also close their accounts at any time. Upon termination, all provisions that by their nature should survive shall survive, including liability limitations and indemnification obligations.

18. Force Majeure

SellFast.ae shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

19. Changes to Terms

SellFast.ae may update these Terms and Conditions at any time without prior notice. We will post updated terms on the Platform with a revised "Last Updated" date. Users will be notified of material changes through email or platform notifications. Continued use after changes constitutes acceptance of updated terms. It is your responsibility to review the Terms periodically.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.

21. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Refund Policy, and other referenced policies, constitute the entire agreement between you and SellFast.ae regarding use of the Platform.

22. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of UAE courts, specifically the courts of Dubai, UAE.
